New 33 substances under control in the Czech Republic
New amendment of the Addictive Substances Act No. 167/1998 Coll. came into effect on 22 April 2001 in the Czech Republic (under No. 106/2011 Coll.) substances (legal highs) mainly from cathinones, piperazines and synthetic cannabinoids groups.
The unauthorized handling of these new NPS shall therefore be prosecuted as a criminal offence or an administrative offence (misdemeanour) as in the case of other NPS.
Since the „amounts larger than small“ (as treshold quantities distinguishing criminal offence and misdemeanour in the case of possession of NPS for personal use or cultivation of plants containing NPS for personal use) are fixed in Government Decrees No.
455/2009 Coll.
and
467/2009 Coll.
, it was necessary to amend these two decrees as well, after deciding on the amounts larger than small in relation to the new 33 NPS; the before mentioned decrees, as well as the decree 454/2009 Coll., has been amended by the government resolutions No 881, 882 and 880 (from 30. 11. 2011. For
